Terms and Conditions
Brushy Mountain Peach & Heritage Festival
By participating in the festival, all vendors agree to the following terms and conditions:
2026 Festival Dates & Location
The festival takes place in Downtown Wilkesboro, NC on:
- Peach Party - Friday, July 24th: 5PM – 9PM
- Peach Festival - Saturday, July 25th: 8AM – 3PM
This is an outdoor street festival that will proceed rain or shine. See our website for directions.
Vendor Eligibility & Application Process
- All applications are reviewed by the festival board of directors.
- Only handcrafted, original work is permitted for craft vendors.
- Mass-produced or commercial items are strictly prohibited.
- Food vendors must comply with Wilkes County Health Department requirements.
- All vendors must pay North Carolina Sales Tax.
Vendor Responsibilities
- Vendors must remain open during festival hours.
- Setup must be completed at least 30 minutes before the festival starts.
- Vendors must provide their own setup (tents, tables, chairs, etc.).
- All tents must be properly secured (no stakes into pavement; weights required).
- Booth spaces must remain occupied and intact overnight.
- No "hawking" or roaming sales are permitted.
Load-In & Load-Out Procedures
- Load-in times and assigned spaces will be communicated by July 15, 2026.
- One vehicle per vendor is allowed in the vendor area at a time.
- All vehicles must be removed from the vendor area by 4:30 PM on Friday.
- Vehicles are not allowed back into the vendor area until after the festival ends.
Vendor Fees & Payment
- Vendor space: $150 for each 12'x12' space
- Payments must be received or postmarked by June 30, 2026.

- Checks should be made payable to Brushy Mountain Community Center and mailed to:
PO Box 313, Moravian Falls, NC 28654.
Insurance & Liability
- All food vendors are required to have liability insurance.
- Craft and non-profit vendors are strongly encouraged to have insurance.
- The Brushy Mountain Community Center and Brushy Mountain Peach & Heritage Festival are not liable for any loss, damage, or injury.
Vendor Parking
- Vendor parking details will be provided with setup instructions.
- No vendor vehicles may park within the festival footprint.
- One parking space per vendor will be provided.
Agreement
By submitting an application and participating in the festival, vendors agree to abide by these terms and conditions. Failure to comply may result in removal from the festival and exclusion from future events.
Release & Indemnification Section
Acceptance and Compliance Required by ALL Vendors in order to Participate
Brushy Mountain Peach & Heritage Festival - hereinafter referred to as "[the] Event".
Release of Liability
For good value and consideration, including participation in the Event, the undersigned applicant and all successors, assigns, executors, administrators, legal representatives, employees, agents, and affiliates (hereinafter collectively referred to as the “Applicant”) forever release and discharge the Event from all claims, demands, losses, costs, expenses, suits, damages, obligations, liabilities, causes of action, and judgments whatsoever, whether in law or in equity. This release applies to any matter arising out of participation in the Event.
Assumption of Risk
The Applicant acknowledges and assumes any and all risks of personal injury, including death, and any damages to property, arising from participation in the Event.
Indemnification
The Applicant agrees to defend, indemnify, and hold harmless the Event from and against any claims, demands, suits, losses, causes of action, liabilities, obligations, costs, expenses, and judgments, including but not limited to injury, death, or property damage, resulting from the Applicant’s acts, omissions, or failure to comply with the Event’s rules and conditions.
Agreement to Participate
I commit to participate in the Brushy Mountain Peach & Heritage Festival in Wilkesboro, NC. I have read this document in its entirety, and agree to abide by all terms, conditions, rules, guidelines, and restrictions.
Final Interpretation
The Brushy Mountain Peach & Heritage Festival reserves the right to final interpretation of all rules.
